By using this website your are entering into a business relationship with Capsid GmbH/jobvector on the basis of our General Terms and Conditions V080527.

Operating company
Operating company of jobvector is Capsid GmbH, - hereinafter called jobvector - represented by its chief executive officers. Any visitor or user of jobvector enters a contractual relationship by visiting jobvector. Any kind of access to jobvector, the retrieving, viewing and uploading of data, any kind of use or visit of jobvector and the therein offered services as well as any declaration of intent made or entered shall be exclusively carried out on the basis of the present Terms and Conditions.
jobvector reserves the right to offer its products and services under a different name. A change of name shall not affect any existing contractual relationship. Any existing contractual relationship shall be transferred in case of a change of name and shall remain valid.

1. Copyright
Any data and information of all kind contained in this website is protected by trade mark and/or copyright law. Consequently, it is strictly prohibited to download, duplicate or distribute all or parts of it. Nevertheless, the technically necessary duplication for browsing or reading as well as a permanent duplication for private use is permitted.

2. Downloads
Downloading is done at your own risk. We do not assume any liability for any damage your may experience through no fault of our own as a result of downloading, installing, storing or using software or content of our website. Although we use the latest virus protection software, we do not assume any liability for any damage or malfunction caused by viruses or what is known as worms.

3. Content
a) We do not and cannot check - which is partly carried out automatically - whether the content of any advertisement that we publish on behalf of third parties is unconditionally legally permissible. We do not endorse the view expressed in such content. As an advertising customer your are responsible to ensure that your advertisement as a whole and its content in detail are absolutely in line with the applicable Law. When publishing an advertisement you commit yourself to indemnifying us upon first demand against all claims arising in connection with the publication of the advertisement, forbearance or indemnification and the legal examination of the legitimacy of such claims.
b) We assume responsibility for the content of our website in accordance with legal requirements. However, we do not guarantee the correctness and completeness, topicality or suitability for a particular purpose.

4. Advertisements and applications
We ask the users of this service to only submit sector specific job advertisements and applications. We reserve the right to delete advetisements or applications that are not related to the sector of sciences.
jobvector reserves the right to change submitted advertisements as agreed upon with the customer, in order to ensure a correct online publication. Furthermore, jobvector reserves the right to make minor alterations to HTML advertisements, first and foremost for technical reasons.

Applications
Please read our Privacy Policy carefully before entering your personal data. Please keeep in mind when releasing your personal data to third parties, that we are not responsible for the data handling of third parties.
We draw your attention to the fact that companies could use your personal data for other purposes than those stated in the advertisement. We cannot monitor this. This is why you should verify the identity of those who receive your personal data yourself. You should, for instance, not send any personal data to a private email address. We also recommend you not to send certain sensitive data to recruiters, even if they ask for them. Such sensitive data include, for example, identity card number, social insurance number, credit card number or bank account details.

As soon as you follow a link to another website and thereby leave our website, we have no control or influence whatsoever upon the content displayed there. 6. Attached files, content
a) Please make sure that you do not send us any attached files containing viruses or worms. Personal data you send to jobvector should not contain the following:

  • Information about illnesses, unless these are relevant for the particular job (except in case of infectuous illnesses)
  • Information about a possible pregnancy
  • Information about ethnic origin, political, religious or philosophical creed, membership in a trade union, sexual orientation.
  • Defamation or degrading information
  • Information that does not have a clear connection to the job specification.

b) Any information you send us must be genuine and must not infringe upon the rights of a third party, violate public regulations or offend morality ("Illegal content"). Please note that you indemnify us against any claims made against us as a consequence of your failure to prevent illegal content appearing in any information you provide.

7. Availability of the service
jobvector offers its services 24 hours a day and 7 days a week. Interruptions will be announced in due time, if possible.
jobvector will remedy failures of its technical facilities as quickly as possible within the limits of the technically feasible.

8. Delay of service and reimbursement
1. jobvector shall not be held responsible for delays of service caused by force majeure or events that substantially hamper or even make it impossible for jobvector to hold the contract, even if obliging time limits were agreed. This holds true especially for breakdowns of communication networks and gateways of other providers even if they are suppliers, contractor etc. of jobvector. jobvector reserves the right to postpone the service for the duration of the breakdown plus an adequate start-up period.
2.In case a substantial hindrance lasts longer than one week, the customer is entitled to reduce in an appropriate way the monthly charges and fees for the duration of the hindrance, as of the moment of such a delay.

A hindrance is substantial

•  if the customer cannot access jobvector for reasons the customer is not responsible for and therefore cannot use the services. The customer must inform jobvector in due time about this hindrance in writing.

•  if using the services becomes complicated, such that the use of individual features is impossible or this complication causes the customer to lose his or her interest in the feature. The customer must satisfactorily show jobvector this loss of interest.

•  in case services are unavailable because of a malfunction jobvector is not responsible for, fees and charges will not be reimbursed.

•  in case the service is discontinued, a pro-rata reimbursement of the not performed services is guaranteed.

9. Automated exchange of data
The automated flow of data from or to the jobvector system is based on a defined set of guidelines, which will be referred to as interfaces in the following. Each interface is based on a specification, which describes the exact performance and the technical details of the interface. The specification is limited to the definition of technical aspects. For the content transmitted §3 is effective. jobvector does assume no liability for losses or damages caused by the inappropriate use of an interface.
Interferences caused by an incomplete specification or a faulty implementation of a specification will be removed as soon as possible. jobvector reserves the right to discontinue the availability of the interface during that period completely or partly in order to prevent damage to the system as a whole. No refund or reduction in price results from this; in addition, the rules and conditions described in §8 are effective.
In order to reconstruct the data exchange and to check possible errors, the content or parts of the contents of the data exchange can be recorded. It is advisable to check an interface in a test phase in a non-productive test environment in order to prevent damages and losses.
jobvector reserves the right to advance interfaces because of new or changed requirements. This is why they are subject to versionisation, which is described in the underlying specification.

10. Prices
The prices are as published in the current price list or as agreed.
In case of purchasing an applicant contact possibility through the Talent pool, the customer buys only the POSSIBILITY of contacting an applicant; the respective applicant has the free decision to reject the request of the customer and to keep the personal data locked.

11. Conditions of payment
Amount invoiced, without deduction of cash discount, within 14 days after receipt of invoice (the respective postmark is effectual). jobvector reserves the right to lock the customer's account after 3 reminders.
Further purchases shall be blocked until all debts are cleared.

12. Liability and limitation of liability
Claims for damages due to impossibility of performance, positive violation of contractual duties and illegal action are excluded unless they are based on willful intent or gross negligence. The liability for warranted characteristics is not affected.
jobvector is not liable for harms that occur due to unperformed services as a result of force majeure or industrial action. jobvector is also not liable for lost profits or indirect harm.
jobvector is not liable for any information communicated through its services. Neither for completeness, correctness or topicality, nor for being free of third party rights or that the sender acts illegally by sending the inforamtion.
For the rest, the liability of jobvector for resulting harms of the customer is limited to the single amount of the agreed monthly fee.
The customer shall be held liable for all consequences and disadvantages that emerge for jobvector or a third party through abusive or illegal use of jobvector's services or that result from the customer not complying with his/her obligations.

13. Place of performance
The place of performance is the registered office of jobvector(Düsseldorf).

14. Place of jurisdiction
The sole place of jurisdiction is Düsseldorf,Germany.
This holds true for any possible litigation between the parties. Only the law of the Federal Republic of Germany shall be applied also for foreign customers.

15. Miscellaneous
The internet is used at your own risk. We are not liable for breakdowns of the website or internet access due to technical issues. We reserve the right to update these terms of use from time to time. The inefficacy of incompleteness of individual rules does not affect the efficacy of other rules.
In case of obvious violations of the General Terms and Conditions, we reserve the right to permanently exclude companies and individuals from the service.
The design is optimized for W3C compliant browsers. In case not standard compliant browsers are used, presentation errors or malfunction may occur.
jobvector reserves the right to temporarily store emails that were sent via the system and to exclude users in case of misuse of the system or annoyance of a third party.

The user agrees that his or her statements of jobvector's feedback form may be used for advertisement purposes and therefore may serve as a reference or testimonial.
